Yes, in Victoria if you have suffered a permanent physical or psychological injury as a result of your transport accident injuries, you may be entitled to a lump sum payment from the TAC. The Transport Accident Commission (“TAC”) provides no-fault compensation, support and benefits to people injured in transport accidents including car, motorcycle, and bicycle accidents, as well as accidents involving pedestrians and public transport.

Following a traffic accident, it is essential to initiate a TAC insurance compensation claim within three years from either the accident date or the date when the injury becomes evident. If your injury has had and will continue to significantly affect your life, you have the option to file a common law claim. The timeframe for a TAC common law claim is within six years from the injury date. 

Motorcycle accidents are sadly quite common, with a reported 200 deaths on Victorian roads between 2017 and 2021.  This represents, on average, 40 motorcyclists per year.

During the 9-year period between 2012 and 2021, there were 1250 motorcycle riders compensated by the TAC for injuries involving an acute hospital admission (1).

Across Australia, and over a period of a year, there were 68,300 motorcycle accidents hospitalisations (2).

Of the 38% of motorcycle accidents with a limit of 60km/h or lower: 

  • 64% involve another vehicle; 
  • 44% occur at an intersection; 
  • 76% occurred with Metro Melbourne.
 

Of the 35% of motorcycle accidents with a speed limit of 100 km/h or higher further:

  • 52% were caused by single-vehicle crashes; 
  • 28% where head-on or overtaking crashes; 
  • 78% were in Regional Victoria.
