All personal injury law firms incur costs during the preparation of your claim.

These include the time your lawyer spends preparing your case and the cost of any disbursements (i.e. filing fees; engagement of medical experts or barristers; obtaining reports) required to support your claim.

If your claim is successful, your chosen firm will seek to recover these costs from the compensation settlement sum.

The difference between firms is their approach to uplift fees and/or capping costs. These can have a significant impact on the amount of compensation you receive in support of recovering from your injury.

To ensure you receive value for money we recommend that in choosing your legal representative you ask what disbursements may be required during the preparation of your case, whether the firm charges an uplift fee and how they minimise costs to ensure you receive most of your awarded compensation.

What percentage do most personal injury lawyers take?

In Australia, personal injury lawyers typically charge a success fee percentage ranging from 10% to 45% of the final amount, with the average being around 33%. At Maxiom Injury Lawyers, we adopt a no win no fee arrangement. If we win a case for our client, we charge a portion of the compensation, with our success fees typically ranging between 15-20%.

What happens if I lose a no win no fee case?
